Complaints and return of goods

Pursuant to the provisions of Section 1829(1) of the Civil Code, the customer has the right to withdraw from the purchase contract within 14 days of receipt of the goods, and if the subject of the purchase contract is several types of goods or the delivery of several parts, this period runs from the date of receipt of the last delivery of goods. The cancellation of the purchase contract must be sent to the Seller within the period specified in the previous sentence.

The Purchase Contract cannot be withdrawn if:
(a) the goods have been modified according to the customer's wishes,
(b) the price of the goods depends on financial market fluctuations independent of the Seller's will and which may occur during the withdrawal period,
(c) the goods are perishable or have been irretrievably mixed with other goods,
(d) the goods are in sealed packaging which have been removed by the consumer and cannot be returned for hygiene reasons,
(e) the supply of food, drink or other goods of general consumption delivered to the consumer's home or to another place designated by the consumer (Art. 1840(g) of the CCC)

In the event of withdrawal from the purchase contract, the purchase contract is cancelled from the outset. The Buyer is obliged to return the goods to the Seller within 14 days of withdrawal from the contract. If the consumer withdraws from the purchase contract, the costs associated with the return of the goods shall be borne by the Seller, even if the goods cannot be returned due to their nature by the usual postal route. The Seller shall return to the Consumer the funds received from the Consumer within 14 days of the Consumer's withdrawal from the Purchase Contract, in the same manner as the Seller received them from the Consumer. The Seller shall also be entitled to return the performance provided by the Consumer upon return of the goods by the Consumer or in another way, provided that the Consumer agrees to this and no additional costs are incurred by the Consumer. If the consumer withdraws from the purchase contract, the Seller is not obliged to return the received funds to the consumer before the consumer returns the goods to the Seller or proves that he has sent the goods to the Seller.

The goods must be returned undamaged, unworn and unsoiled and, where possible, in their original packaging.
The Seller shall be entitled to unilaterally set off the claim for compensation for damage to the goods against the Buyer's claim for a refund of the purchase price.

The Seller has the right to withdraw from the purchase contract in the cases specified in these GTC and further in the event that the goods for objective reasons (the goods are no longer produced, the supplier has ceased to deliver to the Czech Republic, its price or delivery costs have increased significantly), it is not possible to deliver under the original conditions, or the performance becomes objectively impossible, or if the Buyer has not settled all obligations to the Seller due on the date of issuance of the order. In such case, the Seller shall refund the purchase price to the Consumer without undue delay, without cash to the account designated by the Buyer.

In the event that the Seller withdraws from the contract, the Seller shall immediately inform the Buyer of this fact. In the event that the Buyer has already paid the purchase price in full or in part, the amount received shall be refunded to the Buyer in cash:
to the bank account communicated by the Buyer for this purpose, or
the account from which the funds were transferred for the payment of the purchase price, if the Buyer does not disclose any bank account in the withdrawal, within 30 days of withdrawal from the purchase contract.

If a gift is given to the Buyer together with the goods, the gift contract between the Seller and the Buyer is concluded with the condition that if the consumer withdraws from the purchase contract, the gift contract with respect to such gift shall cease to be effective and the Buyer shall be obliged to return the gift together with the goods to the Seller.
